Safety Zone Rule as it applies to Trapping?

Postby Reel-Bonus » Fri Feb 05, 2010 11:45 am

The below text is from the 2009 Hunting guide and defines the safety zones around a building.
At first it appears clear that you could not dispatch an animal with a firearm within this zone unless you had written permission. However, the second to the last sentece says : The safety zone applies to hunting only.

Any thoughts/comments

Thanks, RB

Safety Zones Around Buildings
Safety zones are all areas within 150 yards (450 feet) of an
occupied building, house, cabin, or any barn or other building used
in a farm operation. No person, including archery and crossbow
hunters, may hunt or discharge a firearm, crossbow or bow in a
safety zone, or shoot at any wild animal or wild bird within a safety
zone, without the written permission of the owner or occupant of
such safety zone. The safety zone applies to hunting only. It does
not apply to indoor or outdoor shooting ranges, target shooting, law
enforcement activities or the discharge of firearms, crossbows or
bows for any non-hunting purpose.

I think thats bending the law a bit, but I think you could get a real question answered by the judge after you get a ticket. JMO Jon

Thanks Jon....I agree, I like to err on the side of caution..but it is confusing..I have asked some of my friends and so far the responses have been "the law does not apply to trapping".
It is written like one of those dreaded story problems in grade school that had no clear answer.

I think the DNR or is it DNRE..needs to rewrite this section to make it clear to those of us with 8 grade educations :P

I'll stop now .

I have thought about this long and hard, IMO the DNR write these rules/laws so you are in constant violation. the only time you are not in violation is when your not in the woods. But that is MO. Jon

If I am not mistaken, the wording of hunting also means trapping without saying so, therefore, you would be in violation without permission. Very gray area here. I made it thru 9th grade and then hit algebra and the vile story problems that doomed me for all time in the higher math department. I'm sure this didn't answer your question. lol

I'll ask the DNRE and let you know what I find out.
